Legal Question in Family Law in Indiana

I plan on leaving my husband because of rampant cheating. We have a one year old son whom I take primary care of. We both work full time, and when I'm not watching our son his parents are. I plan on moving to California, and want to know if its legal or not to leave the state with my son. I have not filed any paperwork for a divorce, and I have concrete proof of his infidelity.

If no court order prevents it, either of you may legally have your child anywhere you want. Infidelity is irrelevant. You should consult with an attorney before you take such a step.

Consult with an attorney so that you can possibly avoid significant litigation down the line regarding your child. Infidelity is not an issue in Indiana divorces.
