Legal Question in Family Law in Indiana

Procedures for sole custody

I have a friend that lives in Indiana, and has custody of her two children. She allows the father/ex-husband visitation rights. However, she feels that his drinking problem and living situation is not suitable for her children. She worries that if she has to try this in court, that her children will be taken out of her custody while the hearing is being decided. She is not willing to do this, and I assure you that she is, and has always been a fit mother. Yet she fears that contesting the father's rights, even if only partial rights, would result in her children being put into foster care. I would like to know the procedure for such actions, and what would be in the best interest of the mother.

Re: Procedures for sole custody

You need to give all the facts here. Why would a fit mother be concerned about her kids being placed in foster care if she wants to modify visitation because the father drinks and places the kids' safety in jeopardy? What is the basis of her fear?
