If the parties agree to such provisions, then the same would become part of the settlement and decree. If, however, the judge must decide the case, in order to award the home to a spouse without ordering that a portion of the equity be paid to the other spouse, then he must find reasons why there should not be a 50/50 division or determine that other marital assets being awarded the other spouse equal the value of the house. As to health insurance, the judge could award coverage for about 2 years under the rehabilatative maintenance theory or you could prove that you are disabled and unable to support yourself.
