my daugher purchase a living room suite while she was living with her boyfriend with money from a tax refund that was in a joint bank account,he had told her that half was hers since he got back more because of filing with the child they have. she has papers showing her name on the purchase papers. now that the are no longer together,he told her she couldn't have the furniture. he dosen't pay child support yet,going to court in May. she has paided for everything the baby has needed,with very little help from him, and having the furniture would help her so she dosen't have to make payments on more furniture.

Sorry it took me awhile to get an answer to you. I have been out of town for the last week.

You didn't say what your question was, but I'm going to assume that it is in regard to the furniture.

If she can show the receipt for the items, that she purchased them and that she used her part of the tax refund, then I think she has a good case for getting the items back.

Although it sounds like the hearing is designed just to deal w/the child support issue, your daughter can try to bring up the furniture issue w/the judge. He might make an order on that at that time, saving everyone some time and trouble. However, if he's busy or doesn't want to bother with it, then she can take the ex to small-claims court to get the items back.

A third way would be for her to call the police, show them a copy of the receipt and ask for their assistance in getting the items back.
