Legal Question in Family Law in Indiana
Proving a parent unfit
I recently had a baby and decided to allow the father to see her. However he sends my back with bottles full of rotten milk, he never returns all of the baby's belongings, and the place he is living has no air conditioning and at least ten different animals. His name is not on the birth certificate, and I have decided that he is not allowed to see her anymore unless he takes me to court. If he does take me to court, how can I prove him unfit? It scares me to leave my baby there.

In any paternity proceeding once paternity is established, the court has the duty to adjust custody, support and visitation. If you believe that contact between your child and the father, then you need to ask for a custody or visitation evaluation during the court proceedings. Home studies are also helpful in these situations. occasionally, the court will appoint a guardian ad litem for your child to assist the court in determining what is in the child's best interests. There is always hope that if nothing else happens, the father will learn to become more responsible and a better citizen.
