Proving an unfit mother?

My brother is going through a divorce from his wife. They have one son together, he just turned 3. She has three other children from a previous marriage. She does not work, and has no means to support the kids. She moves back and forth from IN to TX every 3 or 4 months, meaning the kids never finish a school year in one school or state. Is there a way to prove her unfit?

The best thing to do is to get your brother into an attorney's office and talk about the entire situation. If he's been going through this divorce for years (which is the only way your statement that "the kids never finish a school year in one school or state" could be accurate), this has taken too long, and he needs to get things finished.

There are always ways to prove unfitness if a parent is unfit. A lawyer in your brother's community can best advise him on his chances of obtaining custody, if that is what he wants.
