Legal Question in Family Law in Indiana
Qadro
I am recently divorced and in the decree it states I owe my ex-wife a sum of $10,000. This amount was intended to be her half of my 401k. The decree did not state the amount needed to come from my 401k preventing me from withdrawing the amount to pay her. Is there any type of amendemnt I can file on my own to have the court adjust the verbage in order to allow me to withdraw the funds from my 401k. Unfortuantely I did not retain an attorney for our case and do not have the funds to do so now if I don't have to. Please help!

Re: Qadro
QDROS are very tricky things and even experienced attorneys can have difficulty. Additionally, a withdrawal may result in tax implications. You really should hire an attorney. Perhaps you can take out a loan on the 401 K in order to have an attorney handle this situation. Good luck
