Legal Question in Family Law in Indiana

I have a question about child support. The father of my daughter and I are not together and he is paying me money on the side, but it is very inconsistent and I need some consistency financially since he is not helping me care for her in any other way. He is employed, but is currently on short-term disability through work and doesn't know when he is going back. I want to take him for child support through the courts, but I am wondering how they will determine his payment since he is on disability. Will it be based on what he is making now, what he made before he went on disability, or a combination of both? Also, if it is based at all on what he makes from disability, when he goes back to work, how would I be able to get the payments increased? Also, how long does it typically take from the time I file the child support paperwork until I get my first payment? Thanks in advance for your help in this matter.

1 Answer from Attorneys

1) a temporary order will probably be based on the disability income.

2) Later, a permanent order can be entered based on his regular income.

3) The length of time depends on what county you are in.
