Legal Question in Family Law in Indiana

i just recieved an answer that said my ex could not get custody if he is in prison. but i gave my child his last name and he refuses to sign papers to have it changed back to my last name. if he goes to prison, what are the chances his parents will get full custody of the baby since he has their last name?

Her last name has nothing to do with custody.
