Legal Question in Family Law in Indiana

Relocating???

I have sole physical and legal custody of child while ex has the standard visitaions order in Indiana. He is regular on visitaion and support. We have been divorced for 7+ years. The question is .....My current husband's(married 5 years)job has given a rather large promotion at his job that will eventually require relocting(possibly to Europe). What right does my ex have? Can he stop the relocation. As this is a job opportunity we do not want to pass up. The relocation (Europe) could be a 2 year committment. I DO NOT want to lose custody of him. My husband and I also have 2 other younger children who would greatly miss the big brother. Thanks!

I'm going to assume that the order was from Indiana, which requires that a move of more than 100 miles be approved by the court.

You can get court approval by providing notice to your ex of your intent to move and then proving in court that the children will be better off w/the improved financial conditions/lifestyle in the new place.

You MIGHT be ordered to pay for plane fares for visits, but that's not an automatic thing.

Do you think your ex would agree to not contest the move if you assured him that his visits would continue frequently? If that's the case, you can file an agreed entry w/the court and won't have to go to a hearing.
