Legal Question in Family Law in Indiana
Responsibility of Medical Insurance Coverage
My exhusband notified me that he is dropping all insurance coverage he has on our 3 daughters and is putting them all on his new wife's insurance.. Can he do that? It don't seem right, I understand they are sharing expenses, but they don't include her income in figuring child support, why should she be responsible to cover our kids... can she legally put them on her insurance.. I was told since it wasn't her kids that she couldn't do that.. I am worried that something will happen and my girls will end up with no insurance.. Any Info you can give me will be greatly appreciated... Thank you...

Re: Responsibility of Medical Insurance Coverage
Don't blame you for worrying about that. It could be that they have alleged the children are hers or misled the employer and the insurance company. You really have no way of knowing. I'd suggest you contact your attorney immediately. Send a certified letter to you ex instructing him that he is NOT to do that without permission from the Court. Send a copy of that letter to your attorney or bring it in. The attorney may wish to write him a letter setting him straight on the matter.
I'm sure he's just thinking of it as a way of saving money. Nothing wrong with that. But the consequences are too risky. The kids could be uninsured as a result and indeed, his wife could lose her job. Now if her employer is all right with it and the insurance company is all right with it and there's no loss in terms of coverage, well, it might be something to think about doing. But I'd still get it approved by the Court. There's some other "t's" that need to be crossed in this matter (like a line in the order dealing with what happens if she loses her job, dies, divorces him, etc)
