Legal Question in Family Law in Indiana
I have a restraining order against my ex husband for violence and domestic violence. I also have a custody hearing in order as he is also seeking full custody or our shared child. I have a couple of questions. The first being that he violated the restraining order twice in the last two weeks. The police took the report and sent it to the prosecutor in my county. Nothing has yer been done about these violations and I am wondering why it is takig them so long to do something about it.
Secondly as far as the custody hearing, I cannot afford an attorney so am doing everything on my own, documenting everything I have and can. He does not have an attorney either. What can I expect during the hearing and what should I do??

I can not venture a guess as to why your prosecutor has not done anything. Regarding the custody hearing, your question is too open ended to be answered directly. However, the factors that the court looks at can be found in chapter 31 of the Indiana Code. Bottom line is that that custody is granted based on the best interest of the child. You should have witnesses who will help you to prove that the best interest is for the child to be with you. I also suggest that you read and learn the Indiana Parenting Time Guidelines. Good luck.
