How long before a biological father rights can be terminated? My ex has not really seen my son that is 12 for almost 4 years, my husband is wanting to adapt him. Does my ex have to give consent for this to happen in the state of Indiana. My ex's wife contacted me and he is in prision now and is not elg for prorole until March 2010

the easist route to go is to get the biological father's consent to an adoption. If not, then you would have to proceed as a contested adotpion with notice, etc.
