When to seek new legal counsel

I saw an attorney on 11/14/06 seeking money from my ex for my daughter for college. On 12/18/06 there was a pre-trial hearing. At that time mediation was ordered. The mediation session is set for 02/27/07. However, my ex's attorney notified my attorney they would agree to nothing in mediation. Since this seems to be dragging out, I asked my attorney if he could ask the judge to reconsider going straight to trial. I am not happy with the lack of progress in this situation. Does it normally take this long? Or, should I be seeking new counsel? Thank you.

Your attorney is doing an excellent job. And yes, it does take time. In fact, your case seems to be moving along faster than many cases in other jurisdictions. I would not complain. Your attorney has no power to compel the other attorney to agree to anything, or even to mediate. That's a function of the Court. Also, your counsel does not control the court's docket.

It does not sound as if there is a need for new counsel. Counsel has no control concerning the court's calendar or opposing counsel indicating that mediation is going to be a waste of time.
