Legal Question in Family Law in Indiana
I am seeking advice about relocating my family and to a different state. The mother of one of my children is currently incarcerated and has many run ins with the law. She had supervised visits for about two years and in 2014 her visitation and parental rights were removed due to her kidnapping our daughter and putting her in danger. Two years have passed since this incident and she has had no contact with our daughter. She was recently out on bond and violated her bond agreement which led to her being incarcerated. She also taped a note on my front door stating we are all going to die and when I turned in this letter to the prosecutor and victim assistance, the prosecutor stated that this was not worded correctly and he will not press charges on her. Due to my fear for my family�s safety, I notified the judge that I plan to relocate out of state. The first response I received stated that it now conforms with Indiana guidelines. I put in my two week notice to my employer only to receive another letter stating my request does not conform with Indiana guidelines and that I need to seek legal counsel. I went to the website that shows what the relocation request needs to cover. So I sent in the new request to relocate and it covered all areas that were needed. Again, denied. Getting legal counsel would be great but unfortunately I do not have the funds to hire an attorney and all but two attorneys in my area will not help because it is a conflict of interest (they were her attorneys for other situations).
Also, I requested all police reports from 2008-2016 and most of those reports were not given to me or they were changed. I know there is currently an investigation of the corruption in the county I reside but due to my family�s safety we have to move. Considering that she has no rights and my family and I are protected with a protective order that is still valid, would I face legal consequences if I moved?
