Legal Question in Family Law in Indiana

seperation and what to do about business

Me and my lady split up and the home and our business that we shared are all in her name only, we where not married, but we have been together for 8 years. I need to know if I would have a chance to get the business or at least half. I do have witness that the business is half mine and the person himself that we purchased it from could verify that. She also knows that its half mine. So what I am asking is what would my chance be and what are some of the things I should do to get strated with these proceddings.

Re: seperation and what to do about business

Your witness may be of some help, but other documentation may be the key to recovering your interest. Other documentation would include, but not be limited to copies of business checking account records showing that you both could and did write checks for the business, business cards indicating that you are a representative or part owner of the business, invoices where your name may appear or signature where you had accepted a delivery for the business, other witnesses such as customers who dealt with you on a regular basis who knew of your invovement with the business, not to mention your own testimony regarding this issue.

You must act quickly before she sells or otherwise disposes of the business assets. While you could bring action after that fact, she may then not have or have sufficently diposed of the proceeds from it's any sale. Remember, this is not marital property. There will not be a divorce action to recover this, but an appropriate civil action as would undertaken in regard to any business partnership gone bad.
