Legal Question in Family Law in Indiana

Sibling Custody

I'm 21 yrs old inquiring about getting custody of my 12 yr old brother. Our biological mother has custody right now, and his father has been in and out of prison. From what my mother has told me, my brother is not allowed to have contact w/ his father until he is 18. My mom has nothing to her name, fequently changing jobs. The home is discusting. They let the dogs use the bathroom in the house and it will sit for days, dirty laundry everywhere, dirty dishes soaking in the sink for days...I am currently deployed to iraq and she has been constantly asking me for money to pay bills. REcently 1,500 to move out of her boyfriends house, but used the money for other things. I am coming home from iraq within a couple weeks, and in Feb 06 i will be moving to california on a 3 yr non-deployable tour. I've talked to my leadership and my chaplain about this issue. Both said to think about persuing custody. Do I have a chance? He has no other family besides our grandparents which are in their 70s.

Re: Sibling Custody

Indiana law does allow for you to obtain custody, so yes you do have a chance. You need to get all of your ducks in a row in terms of housing, childcare, schooling, etc. before taking any other action.
