Legal Question in Family Law in Indiana

my sister died 03/2013 she and her children have lived with my parents for the past 10 years. Question is: Can my parents successfully be granted guardianship, custody or adopt my sister's 12 yr old daughter? Her biological father is in jail and hasn't nor will he ever have to legally support the child because he recieves SSI. My niece has lived with my parents since she was 18 months old. My sister had always had custody of my niece and her other 3 children and also lived in the household until her death March 29th of this year.

More than likely they can obtain guardianship for the children. It would have been wise for your sister to express her wishes in a will before her death, however.
