Legal Question in Family Law in Indiana

My son is 16 and i got court papers today saying that his father has filed for custody of him and my son agrees he wants to live with him, but i have had him for 16 years and his brother that was in his fathers care is now in juvinile detention center because he could not be controled (his father refused to give him rules or disipline) i do not want him to live with his father because i am afraid because he is allowed to run wild with no boundries he will turn out the same way. what can i do to stop this?

A child's choice is only one factor that a court looks at when considering a modification. The court will look at what is in the best interest of the child. You should hire local counsel who can help you gather the necessary evidence to counter your child's preference.
