My son has a 4 1/2 month old daughter. They have been staying at my house said said child was born. This also includes said childs mother. My son works every day but got into a bit of trouble and has to do week-ends in jail. The mother has threathen to remove the child from a safe and healthy enviroment and take off with her. Childs mother doesn't have a job. Is there a way that my son can get emergency legal custody or myself until we can get custody papers filed?

No, there is not. Your son has to request custody and obtain a hearing date. He should seek an attorney to do this. If you are seeking custody, alleging that the child's parents are unfit, then you should see an attorney. You should not both see the same lawyer regarding your individual rights.
