Legal Question in Family Law in Indiana

My son was recently in carserated and has costody of his 8 yr. Son I was told that when he went in his righs would automatically transfer to me and his his father.I was told this by the judge and his criminal lawyer and divorice lawyer.The mother has him this month with us having him on 2 nights during the week and everyother weekend now she's theone who asked for this I thought i could TRUST her now with her reusing this she's in contempt and I need to know what I can do now.My son get out on the 11th of July and her and him go to court on the 15th which is fine I'm in the court with him Now heres my question:What can I do now to get the boy back home before his dad gets out??I'm being told by her thatas the Parental grand parent I have no rights My son is willing to singtemporary custody to me Today should we do this??

Please report and tell us what the problem is. This posting doesn't say what you think you should have or what is best for the boy. No custodial parent's rights ever automatically "transfer" to anyone else.
