Legal Question in Family Law in Indiana
If my son and his wife are filing for a divorce, they both still live in the home because the provisional hearing has not yet been set. He lets me the grandma of the his daughter take her to another state for a family reunion without him. Although she agreed up until the last day then she decided she didn't want her daughter to drive long distance because she could get in an accident. Yet he is still ok with my taking her? If I take her can I get into trouble. This trip would be from thursday afternoon to monday evening.

Until an order is issued, both have equal rights to where the child will be. That being said, why would you take this step if they were in disagreement about it? When was the "last day"? I would advise that you not take action which will further problems between the two of them.
You have the right without an order to take her with just your son's permission basedo n the information provided..
