Legal Question in Family Law in Indiana

My son-in-law has two children age 6 &5. They live with a garudian and she says she wants to adopted them. The father has been trying to get custody of them for over a year now. Court hearing after court hearing and nothing. So bottom line can this lady adopted them without contacting the father, she knows he wants these boys.The mother of them doesn't want them. He needs help. Thanks for all your help. Ms. Luellen

Both parents have to receive legal notice for the adoption. However, if the father has not been contacting them or supporting them for over a year, his consent is not needed. Your son-in-law really needs to pay for an attorney if he is serious about all of this.

Without knowing the facts of the guardianship, it is difficult to evaluate the situation. However, I do suggest that he contact an attorney as soon as possible.
