sons name on birth certificate, thru DNA found out not his, dow we have any legal rights?

If your son is still legally the father, and a court has not said he is NOT or that another man IS, then you still may have grandparental visitation rights depending on the custody/parenting time arrangements that exist. You should consult with an attorney in your community as to how best to enforce those rights.
