Legal Question in Family Law in Indiana

My son's father was so far behind in child support the state issued me his tax refund due to be released in November. After he filed and received a child support modifaction he is over paid and i was told to return the tax check. My question is, is if I keep the check can I receive criminal charges or will it only prolong the time he makes reduced payments due to over payment?
