Since my son's father is not involved, has no child support order, and is not on the birth certificate, is it legal for my husband to sign his birth certificate in order to become my son's legal parent?

firstly you have to clarify the following details whether your second husband is legally wedded husband? whether you have obtained divorced from your first husband? you obtained child custody through court? further if the father of the child have no objection your husband can sign this birth certificate.

No, your husband needs to adopt the child in order to become a legal parent.
