Legal Question in Family Law in Indiana
My sons mother refuses to follow our court order. We have had two court orders in the last year and she just won't follow them. We went to court last month and the judge accepted printed out text messages as evidence of her denying parenting time. Now she is back at it. Fathers day is next weekend and she has already come up with reasons not to let me have my son. I asked if she would do mediation to resolve this and come up with a parenting plan that she would actually follow. She refuses mediation. I wanted to avoid going back to court over this. She even claims I'm lying about her breaking the court order. I don't understand why she is lying about it when the judge even has evidence of it. I have voicemails of her badmouthing me in front of our 2 year old and her boyfriend doing the same thing. How can I convince the judge that she just is not going to stop and my son would be better off with me? I have no problem following a court order and I would never and have never spoken poorly of her or her boyfriend around my child. My fiancee and I are also having a baby in a few months and I want my son to have a good relationship with his sibling. My ex does not want that at all. Any advice is appreciated. I can not afford a lawyer.
