SSI Disibility
My ex-husband has been awarded SSI Disibility approx. one month ago. He will be collecting a lump sum for four years back. He has never paid child support and has a current rearage of more than $20,000.00. How do I make sure that his rearage dollars due in support are taken fron his lump sum and paid to his son?
I am getting two conflicting answers fron the Prosecuting Attorney's Office and the Social Security Office. Each saying that the other party decides the dollar amount to be set aside to be paid for the rearage due, and the amount to be garnished from his weekly disibility check for his son.
The father has also petioned the court to modify his child support due to his disibility, which is set at mere $65.00 a week.
He also has filed a verified motion for contempt saying that I have failed to comply with guidelines for him to see his son. He has been called to appear for contempt of not paying his child support. Although they have not been able to proceed against him as he has been trying to get disibility for the past 3 to 4 years.
How do I proceed against him?
He has not held a valid drivers license, no income,he has been living on the streets, so he says. So he has no appropriate home to even visit with my son.
