Legal Question in Family Law in Indiana

Out Of State Visitation Rights

I have moved from Indiana to Tennessee and I have a three year old son which I have joint custody of in Indiana. His father won't let me have visitation with him and let me bring him to Tenn. where I now live with my other four children. He says it's his way or no way. When I call my son he normally doesn't answer his phone. And when I go see my son he always has more impotant things to do with him then let me see him and I always have to wait in line to spend time with him.I need some good advice so I can get my son at least for visitation and to maybe get him back in my care where he belongs with his siblings. Thank You So Much...

Re: Out Of State Visitation Rights

You need to go back to Indiana and enforce your visitation rights through the court. you ex cannot dicitate the visitation. Also, since you have relocated, the visitation needs to be formally addressed with the court.

Sounds like you need to file a petition for contempt for denial of visitation rights and return to Indiana for the hearing. The other parent does not appear willing to accomodate you, hence you need to take your complaint to court.
