Legal Question in Family Law in Indiana

step child adoption after biological parent's death

My step daughters mother passed away last year, I want to adopt her. My husband approves of this. We live in Indiana. What is the simplest and easiest way to go about it? This may sound crazy, but we are going to divorce after the adoption. We are in agreement of the terms and custody arrangements for the divorce. Do we need to mention the divorce in the adoption process?

You need to contact an attorney to draft the adoption papers. Under no circumstances do you want to mention anything about a divorce!!!!! Also, do not file for divorce until after the adoption is final. There is a streamlined procedure for stepparents that would not apply after a divorce.
