Legal Question in Family Law in Indiana

Step Parent adoption, My wife and are wanting "me" to adopt my stepdaughter who is 4 and the oldest of 3. Her bio dad has been in Prison since 2005 "before she was born" for child molestation x2.

He has never seen her and she has no idea who he is. Shes called me Daddy since she could say the word. Would I be able to adopt without his knowledge? Or would we be able to file abandonment even though he is in prison? What would be the best way to go about this?

It sounds like you can get this done. Bio Dad will have to be notified, but you probably won't have to get his permission.
