my step-daughter\'s cusodial parent is leaving the 15 y/o at home alone while working third shift about 40 miles from home. Is there anything the non-custodial parent can do legally?

Yes, insist that the child spend those nights with the non-custodial-right of first refusal-shouldn't be able to get around the parenting time guidlines provision for right of first refusal by not even getting a sitter.
