Legal Question in Family Law in Indiana
I want to sue my Husbands mistress
My husband was having an affair with a coworker early 1999. I feel it was during a troubled period with us, She then found out she was pregnant, had the child, her mother called me when the child was a month old at home and at work and would leave messages on the answering machines. Paternity has been found out and he is paying child support, but I want damages for the pain and suffering she has caused ME and I want her to have to suffer for what she has caused. We have a 8 year old and I have to hid this from him till the time is right. My husband has owned up to this and has paid dearly, we are still together and I plan to stick with him, he is a good person who made a mistake. She is a blood sucking tramp who has another child by who knows who, only a year and a half older than this child.I only found out about this a year ago and the child will be one this month. Do I have recourse against her? Thank You for your time.

Re: I want to sue my Husbands mistress
No, there is no right to sue the other woman. Of course, at the appropriate point in time, your husband may want custody and proof that it would be in the child's best interets would require your willingness to have the child in your home, your relationship with the child and a determination that the child will be a welcome member in the home. Otherwise, there is no financial solution to the question you pose. There is no longer recognized the type of action you suggest - alienation of affections.
