suing step daughter

3 years ago my stepdaughter was in a car accident i hired a lawyer to sue because it was not her fault and to get the medical bills paid well as it turns out my car insurance did pay out but not to me! in the staste of Indiana says when she turns 18 then they pay her the money well she refuses to give me any of that money that i paid for medical bills which is the rason i hired a lawyer to begin with! I would like to sue for what i paid out of pocket for medical tyhe rest of the money she can have ! 25000 is what the settlement was and medical was around 12000 out of pocket. is there anything i can do legally?

There are several thing you may be able to do based on the facts you gave me, but you need to speak with an attorney. I am a bit confused that if the PI attorney knew that you had paid bills that you were not reimbursed. Things do not seem as simple as you might think and you need to have a long talk, in-depth talk with someone.

In my 25 years of practice, can not say I have heard of this situation.

First of all, what does her father have to say about this? You did not mention him at all in your posting. Has he tried to discuss this with her at all? Secondly, what does the attorney who you hired say about this? He knew that this was out of pocket expense of yours and in fact he may have an ethical obligation to make sure that you were paid.

Thirdly, you might want to look at the divorce decree as there may be a provision in there requiring her mother to pay a share of the out of pocket medical expenses. Bringing her into this, might put some pressure on your stepdaughter.
