Legal Question in Family Law in Indiana

can he really get him for summers?

I have a 5 year old son who his father has been in the military ever since I became pregnant. He comes home once a year for a week to visit, which i had to talk him into from the get go. then when he started to want to take charge, i made him start sending money if he wanted to see him at all. he paid me $100 a month for 3 years, then 125 and now $150 a month. he lives in north carolina and i live in indiana. hes threatening to take me to court for custody so he can get him for the summers. he is not on his birth certificate, he has my maiden name. and the support he pays me is not through courts, he has no legal rights as we speak. is it possible that he could get the rights he speaks of? is it possible i will have to send my son to north carolina?

Re: can he really get him for summers?

If he is the father and establishes that he is through a paternity action, it is possible that he would be allowed to see his son during parts of the summer. This issue is complicated and can not fully be explained in this forum. You should contact an attorney. You are welcome to contact me. I work with a law firm that handles family law matters throughout Indiana.
