Suspending Visitation

My mother has terminal cancer, life expectancy 6-12 mos. I would like to suspend the Christmas visit this year in order for my daughter to spend the last Christmas with her grandmother. Her father won't agree to this, stating he takes precendence over my mother. My daughter stated she wants to spend Christmas with her grandmother. What steps can I take to suspend this visit?

If your decree is from Indiana, you need to petition the court for authority to modify visitation or parenting time if the non-custodial parent refuses to modify the same. If you merely deny visitation, he can file a petition for contempt and as a remedy the court will order make-up time and order you to pay his attorney fees.

Suggest a trade of dates. If he refuses you should ask the court to intercede.
