Legal Question in Family Law in Indiana

Tax Deduction

Divorce decree declares I get tax deduction for daughter in odd numbered tax year and ex takes the deduction in even years; but she refuses to sign IRS paper. Is my only recourse take her back to court for contempt? I've been thinking about filing to stop child support and start paying college costs for 18 year old daughter who starts college next month (she lives with mother but is moving to college campus as soon as she graduates high school). Would tax deduction for college costs make it worth going back to court? Thanks!

Re: Tax Deduction

Yes, your only solution ever in enforcing a court's Order is to go back to that court.

As for whether you will get a better tax treatment for the college expenses rather than the exemption, you need to check with your accountant and run the numbers. All I can say is that you will need to go to court and get the Decree modified.
