Legal Question in Family Law in Indiana

temporary legal guardianship

we have a grandson whose parents have seperated. His father is in Tennessee and his stepmother is in Indiana. We also live in Indiana and would like to take care of our grandson while he finishes school. His father will take him when he makes arrangements with his job so that he can be home at night. We'd like to be his guardian in the meantime so there will be no involvement with CFS.

Re: temporary legal guardianship

You need to obtain a legal guardianship. For that, you will need to hire a lawyer for prepare the paperwork and submit it to the court and hold the hearing. Unless the stepmother adopted the child or was awarded custody for some reason, she has no say in the matter. The birth mother could be a problem in getting a guardianship or could pose a problem for custody by the father. You really do need to consult with an attorney about the matter before you do anything.
