termination of parental rights in Indiana

I am trying to find out how to terminate the parental rights of my child's father. I have talked with an attorney in my hometown and she has indicated that in order to get the judge to sign off on this, we need to have a statute or case law to back this up. The father has not seen the child since 1996 and has not paid support or made any attempts to contact. I need to know if there is any supporting case law or statute. My concern is that if something happens to me he could take custody and remove her from the only family that she has ever known.

You can ask that his parental rights be involuntarily terminated.

Sounds like your case might be a good one for that.

That won't relieve him of any past-due child support, but it will relieve of the duty for any future support and will mean that he won't have any contact rights w/the child.

Do you have a spouse who wants to adopt the child?

That will certainly help....
