Legal Question in Family Law in Indiana
I have twin sons, and one of them is on an extended visit with his father in NM, I have full legal and physical custody through an Indiana divorce decree. I have asked him to return my son early due to his behavior while they were in his custody, as well as the recent diagnosis of my oldest daughter life threatening illness. He refuses to return him, and even tried to file a motion in NM court to take physical custody. I want my son returned to me and I'm not sure what steps need to be taken.

Sit down with an attorney and explain what the original terms of the stay were to be, and how they were violated. Your daughter's situation has nothing to do with it.then you can decide whether to go to court to order he return , or maybe pursue criminal charges.
Contact a local attorney and have a copy of the custody order and any documentation concerning the extended visit. I am unclear what you mean by having him return due to behavior but you need to discuss that in detail also.
