Legal Question in Family Law in Indiana

Visitation Credits ??

I have been trying to get back child support from my X. I went to the Child Support Enforcement Office for help over two yrs ago. Now 3 case workers later, no follow up but what I have tried to do over the phone, many letters and forms completed, asked appts. denied to me,, I am in shock...I have been told my X has been given ''visition credits'' for the back support due. I am shocked because he told either the courts or his lawyer he was seeing his daughter and for some reason he was given credit for those visits. The funny thing of all of this is he isn't seeing his daughter like he says and the summer visition of 3 wks is the only time he can pay 1/2 of the weekly supoort due. He hasn't seen his daughter but 2 weeks in the summer total. Can he just waltz into court and tell them he wants ''credit'' on back child support? I have proof he isn't so how can this happen ???? How can they just take his word? I have NOT been asked anything. I have never heard of such a thing. My case worker told me to write the district attourney's office and tell them what has happened. What good will this do ?? I live in TN and he lives in IN. so why will they believe anything I say? I need a lawyer in IN but can NOT afford one. I need help !!!

Re: Visitation Credits ??

I am not familiar with Indiana Child Support laws. If you are receiving benefits from the state of TN you can simply make an appointment witht he child support enforcement agency and pursue things through the TN office. If you are not receing state benefits you can make an appointment apply for state services to enforce the judgemnt. I would first make an appointment to talk with someone. If you would rather pursue the matter privately, contact an attorney. I clan help 423 266-4855
