Legal Question in Family Law in Indiana

Visitation when exparte has been filed

Need an answer ASAP Plz!!! my boyfriend has visitation rights to his 2 girls. we live in MO, mother lives in IN. They are supposed to meet 1/2 way in Effingham, IL. 2 weeks ago, he had his visit with the girls for 2 weeks, when we returned the children to effingham mother claimed that he grabbed her and put marks on her. he went to jail for domestic battery and we assume there is a restraining order. does he still get his visitation and phone converstaions with his children? if so, how do we go about it since the restraining order will say that he cannot contact her? HELP!!!!!!

Re: Visitation when exparte has been filed

Your post fails to tell us where any existing Court Order establishing custody and visitation rights was entered. Was it in MO? Was it in Indiana? I would venture a guess that the law of the state where that Court Order was entered will provide the answers to your questions. If it's MO, then I would need to spend a modest amount of time researching the question before I could give you a definitive answer. If its Indiana, you will need to consult with an Indiana attorney. In the meantime he needs to take care of the criminal charges in Effingham, and even though I have handled felonies there I would suggest that he obtain local defense counsel. Good luck1
