Visitation
I live in Illinois and my ex-wife lives in Indiana where our visitaion order is set. She gets to visit my son every other weekend. I recently lost my job of eight years in Illinois due to my company closing down. I've been offered a management job in Masachusettes. Will I be allowed to move away? How would visitation be set up? Could I be at risk to represent myself or is it a simple request in front of the judge? Thanks in advance. Brad

I don't know Indiana law, but, in Illinois, you have to do a motion to be allowed to move the child, but if it's in the best interests of the child it's typically granted. Visitation would have to be modified due to the distance, but it ca be done. You might want to contact a local attorney to help you because it's possible your ex will contest it.

You can certainly ask the court to allow you to leave. It will be up to you to show why you are requesting it. The only risk you face with representing yourself is that you may lose your motion, since you do not know what to say or the legal requirements to satisfy.

In Indiana, this is not a simple procedure. There is a specific statute
that must be followed in terms of notice, hearings, parenting time. You are at risk if you try and do this on your own. You should hire an attorney.
