Legal Question in Family Law in Indiana

visitation

My soon-to-be ex-husband wants me to provide formula, diapers and baby food for our 8 month old daughter for his week-end visits. Is this my responsibility?

Re: visitation

I'm assuming that you have primary physical custody and he has visitation and pays support to you.

Even if he's paying support to you, he's not off the hook to pay for such things himself when he has the child.

The support guidelines calculate that BOTH parties will be expending money and resources on the child. The fact that he pays support to you does not mean that all the items that the child needs come out of that amount of money. That money is to be used for upkeep of the child while the child is in your custody -- for food, clothing and shelter. But when the child is with him, HE is supposed to fund those things, not ask for a rebate, in essence, to cover the costs for his weekend time w/the child.

This guy sounds like he doesn't understand how things work -- or knows but wants to manipulate you.

Hope this helps answer your question. Let me know if you have others. OK?
