Legal Question in Family Law in Indiana

visitation

My x-wife calls me several times whenever I have visitation with my kids. Even when the parenting time is only 3 hours in length she calls and demands to speak to the children. This disprupt my time with them and upsets the kids. What can I do legally to make her stop because I've asked her to stop but she refuses. Am I required by law to answer her calls during my visitation?

The Parenting Time Guidelines govern this and state as follows:

3. With A Child By Telephone. Both parents shall have reasonable phone access to their child at all times. Telephone communication with the child by either parent to the residence where the child is located shall be conducted at reasonable hours, shall be of reasonable duration, and at reasonable intervals, without interference from the other parent.

You can file a Petition for contempt since she is violating the Parenting Time Guidelines.

This is a matter of common sense for most judges. She doesn't have the right to speak with the children at any time no matter what you are doing unless the court specifically gives her that right.

There are other things going on here. Either she is particularly paranoid or there is a verifiable history of problems with the children while in your care. Either way, you should talk to an attorney in your area to get at the root of the problem, and give you more specific advice.
