Legal Question in Family Law in Indiana
My wife filed for divorce and we went to court. She was granted the house. The mortgages were to stay in my name but she would be responsible for paying them. 5 months later we reconciled or was made to believe we had. We let my apartment go and I moved back in to our home. One month later she moved out with our 2 kids into an apartment she got behind my back. I was informed she was proceeding with the divorce settlement and I could have the house. When she finally gave me the financial mortgage paper work I learned both mortgages were 4 months behind and in default. She had received the notice of default and acceleration around the time she asked me to move back in. I was served a summons in regard to one of the banks suing me for foreclosure. She was also named as codefendant. Now she says she has nothing to do with it and her lawyer sent notice to the court. I have not signed the property settlement for the divorce yet. Is she responsible. Can they come after her to if I sign off on the settlement? I am debating hiring a lawyer now to help keep the house and to help me not get screwed in the divorce settlement. Would it be worth it? If I don�t sign what can she do to force things forward?

Debate it no further. Yes, you should have a lawyer. Find a family law attorney in your community and ask these questions of him/her.
