Legal Question in Family Law in Indiana

my wife and i have seperated we have a child together,we both live in lebanon in.

we never filed for a speration or divorce. she is currently having problems at her current home with cps.can i legaly decide to keep my child and not let him go back to her home with out getting into trouble.i really feel it is un safe for him to stay there.

If legal paternity has not been established in court or by affidavit, you probably need to contact cps in the short term and file for paternity.

As a married couple, either of you has the right to have your child anywhere in the United States that you wish without permission of the other one, unless a court has jurisdiction due toi a separation or divorce filing. If you take the step you are contemplating, do not use any force , violence, or subterfuge.
