Legal Question in Family Law in Indiana
Should we be worried about our support
My husband has custody of his son from a previous relationship. Recently, his son's mother let him know that she was quitting her job because she is getting married. We took her back for more child support a little over a year ago and she put up quite a fight then even though she had been paying a VERY SMALL amount for 7 years. We had the support money taken directly from her paycheck, and we are very worried that she will either stop paying or ask for a reduced amount. I know that her soon to be husband's income can't be taken into consideration under normal circumstances, and he has 5 children of his own that he is supporting. Since support is established based on the combined income of both biological parents, we were wondering about how these types of situations are handled and what we should do to prepare for the inevitable.

Re: Should we be worried about our support
If she stops paying support, then your husband can ask the court to hold her in contempt.
The presumption is that if a person is found in contempt, the filer's attorney fees will be reimbursed to him/her by the person found in contempt.
