Legal Question in Family Law in Indiana

Young mother seeking sole custody

I am 18 years old, and I am going to give birth to a baby in about 2 weeks. I am not with the father, and would like to know the pros and cons to putting him on the birth certificate. Also, I am thinking of pursuing sole custody. I am a full time student, and I live at home with my mother. He recently got fired from his job because of his temper problem, and he lives in a remote area in an old run down apartment. He is also verbally abusive to me, and has done absolutely nothing to prepare for a child. What are my odds at gaining sole custody?

Re: Young mother seeking sole custody

Based on the facts given, it would seem that you and the father are not married and of course that paternity has yet to be determined. Therfore, there is no custody issue for him at this point in time. You are birth mother and under the circumtances you have sole custody. Placing his name of the birth certificate simply helps to advance paternity. Establishing this is something you should do after the birth of the child for child support. The father may not be employed now, but will be. Establishing him as the father may help you with the costs of the child down the road. Unless there are major issues as to the care of the child, it is doubtful that a challenge for custody will be of any real concern.
