Retroactive FMLA

I missed 5 days in January for asthma. I was written up for it. I found out that it qualifies for FMLA. Can they continue to hold those days against me. I have since asserted my FMLA rights.

As you have described the situation, the only way they can hold those days against you is if you have exceeded the maximum 12 weeks of leave protected by the FMLA. Please feel free to contact me if you want to discuss pursuing your rights.
